credo di essere stato mal interpretato. Onestamente non mi ha mai sfiorato l'idea che questo gruppo dovesse avere un approccio invasivo, per quale ragione dovrebbe? Al contrario, credo siamo tutti d'accordo sul fatto che l'obiettivo dovrebbe essere di provare a migliorare, se possibile, alcuni punti di un complesso di regole e guidelines che oggi già funziona. Il mio voleva solo essere un modo per stimolare interventi e cercare di focalizzare la discussione su alcuni punti del CAD e che questi emergessero sotto forma di proposte/idee su cui possiamo iniziare a discutere.

Condivido le perplessità di Daniele (in parte): non siamo qui per riscrivere TUTTO alla luce del CAD.
Però, così come il punto era stato sollevato in CIR, credo che ci sia agio per fare qualche intervento specifico che, alla luce di quello che è stato normato in Italia, ci consenta sia di semplificare le procedure, sia di avere maggiore confidenza che esse siano adeguate rispetto ai requirements.
Tanto per non parlare troppo astrattamente, io proverei a fare [anche] il percorso inverso:
"Quali sono i punti del contratto/guidelines/regolamento che possono essere migliorati [alla luce del CAD]?"
Mi sembra che sia importante confrontarci anche su questo, perché ho avuto l'impressione che da un lato ci sia una presunzione "massimalista" (rivediamo TUTTO), ma che dall'altra ci sia una visione molto minimalista, del tipo:
vediamo se è possibile formalizzare come "documento informatico" quanto viene inviato dal Registrar a richiesta del Registro per provare l'avvenuta transazione di registrazione (spero di aver reso bene il concetto, anche se ho usato una terminologia approssimativa...).
A me sembra che dovrebbe essere possibile fare qualcosa di più, perché, se ho capito bene, con questo approccio "minimalista" non andremmo ad avere nessuno dei vantaggi che IL documento informatico dovrebbe darci; si tratterebbe unicamente di prendere un tabulato (sulla cui consistenza e validazione esprimo - da sempre - dubbi), inbustarlo elettronicamente, acocmpagnarlo da una letterina firmata che attesta che "tutto è vero ed autentico sotto la responsabilità del titolare del Registrar", e via così.
Vero è che per chi è all'estero già questo non sarebbe banale, ma io spero che si possa fare di più e di meglio.
Ed il nodo chiave penso che sia nella generazione dell'audit della transazione, il VERO documento informatico di cui si dovrebbe poter dare prova di veridicità (e di marca temporale!).
Possiamo partire da questo? A me continua a fare specie che il Regolamento parli di "forma scritta" quando tutta la procedura da tracciare è immateriale.
